The Judge's Decision

The OATH judge will decide the case within three business days and send a written decision.

If You Win the Hearing

If you win the hearing, the Police must return the car within 10 days.

To get your car back, you will need to take the following to the car pound:

  1. A valid driver's license for the person who plans to drive the car away. The driver does not have to be the car owner.
  2. The Police Department Release Memo, which the police department must give you after you win the Krimstock hearing.
  3. To be safe, you may also want to bring proof of title to the car and the DA's release form if you have it. Please see District Attorney's Release page of this website for more information on the DA's Release.

If you win your case, you will usually not have to pay an impound lot fee. If the impound lot tries to charge you a fee, you should call the New York City Civil Enforcement Unit at (917) 454-1111.

If You Lose the Hearing

If you lose your hearing, you could wait until the City brings a forfeiture proceeding for your next chance to get your car back.

Or, you might decide to start a case in New York state court called an Article 78 proceeding to challenge the result of the OATH hearing. There are strict time limits for this and you should consult a lawyer at once.
